The prices mentioned at the time of ordering will be the prices charged on the date or time of the delivery. Although prices of most of the products do not fluctuate on a daily basis, some of the commodities and fresh food prices do change on a daily basis.

3.1 We maintain the absolute right to decline any purchase request at our sole discretion including restriction and/or cancellation of quantities ordered per household or per individual, particularly in instances where we suspect the buyer is an unauthorized distributor or reseller.

3.2 We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, or more timely sources of information. Any reliance on the material on this site is at your own risk.

7.1 At EM Agri Goat Farm, we strive to deliver the highest quality fresh produce. Due to the perishable nature of our products (fruits, vegetables, dairy, meat, and bakery items), we do not accept returns after a delivery has been accepted. However, we offer refunds or replacements for items that do not meet our quality standards.

7.2 Reporting Issues:

(a) Perishable Items: Any issues regarding quality, freshness, damage, or missing items must be reported within 2 hours of delivery.

(b) Non-Perishable Items: Issues with packaged goods (e.g., canned food, staples) must be reported within 24 hours of delivery.

(c) Required Proof: To process your request, you must provide clear photos or a short video showing the defect, the original packaging, and the invoice.

7.3 Eligibility for Refunds or Replacements:

(a) The product is damaged, spoiled, or unfit for consumption at the time of delivery.

(b) The product has passed its expiry date.

(c) The wrong item was delivered, or items are missing from your order.

(d) The delivery was significantly delayed beyond the promised window, affecting the freshness of the goods.

7.4 Third-Party Delivery Disclaimer: If your order is delivered via a third-party platform, we ensure all items are in peak condition when handed to the delivery partner. If items are damaged during transit or if the delivery agent fails to follow handling instructions, we will coordinate with the delivery platform to resolve your claim.

7.5 Incorrect Address: We are not responsible for spoiled goods if the delivery fails due to an incorrect address or if the customer is unavailable to receive the order at the time of delivery.

7.6 Non-Refundable Situations:

(a) Change of Mind: Once an order is processed or out for delivery, it cannot be cancelled or returned.

(b) Improper Storage: Quality issues arising from improper storage after the delivery was completed.

(c) Minor Variations: Natural variations in the size, shape, or color of fresh produce that do not affect quality.

7.7 Approved refunds will be credited back to your original payment method within 5-7 business days, depending on your bank's processing time.

8.1 Delivery Areas & Scope:

(a) Domestic (Local): We may endeavour to deliver your orders on same day or next day to delivery locations within a 25 kms radius from our warehouse.

(b) Domestic (National): We may endeavour to deliver your orders within 3 to 5 days to delivery locations within India.

(c) International: We ship to select countries where import laws allow the entry of fresh/packaged food. Please check your local regulations before ordering, as some regions prohibit fresh produce.

8.2 Shipping Methods & Third-Party Carriers:

(a) Third-Party Logistics: We partner with specialized couriers to ensure timely delivery.

(b) Cold Chain Management: For highly perishable items, we use temperature-controlled packaging, including gel packs or insulated liners.

(c) Liability Handoff: Our responsibility for the physical condition of the goods ends once the package is handed over to the third-party carrier. However, we will assist in resolving disputes regarding transit damage.

8.3 International Shipping, Customs, Duties, & Taxes:

(a) Import Duties: International customers are the "Importer of Record" and are responsible for all customs duties, taxes, and clearance fees.

(b) Documentation: We provide mandatory export documents, including FSSAI licenses, Commercial Invoices, and Phytosanitary Certificates where applicable.

(c) Customs Delays: We are not liable for spoilage caused by customs holds or biosecurity inspections in the destination country.

8.4 Order Processing & Timelines:

(a) Cut-off Times: Orders placed after 17:00 hrs will be processed the following business day.

(b) Freshness Guarantee: To ensure maximum shelf life, we do not ship perishable items on weekends or public holidays to avoid warehouse stagnation.

8.5 Delivery Expectations & Tracking:

(a) Real-Time Tracking: Once dispatched, a tracking link from the third-party platform will be sent via email/SMS.

(b) Recipient Responsibility: For fresh groceries, the customer must be available to receive the package on the first delivery attempt. We are not responsible for spoiled goods due to missed deliveries or incorrect addresses.

(c) Tamper-Evident Packaging: All orders are sealed with tamper-evident tape. If the seal is broken upon arrival, please do not accept the delivery and contact us immediately.

8.6 Shipping Costs:

(a) Calculated Rates: Shipping fees are calculated at checkout based on weight, volume, and destination.

(b) Non-Refundable: Shipping charges are non-refundable once the order has been dispatched.

9.1 Any content, branding, and service structures including trademarks, marks, and copyrighted proprietary information/material including text, photographs, logos, software, videos, sound, graphics, music and company information provided through this website are the intellectual property of our business.

9.2 You are strictly prohibited from duplicating, selling, or exploiting any segment of the Service and/or from using any marks and any information/material provided through this website for any purpose whatsoever without obtaining our prior written authorization.

10.1 The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

10.2 These T&C are effective unless and until terminated by either you or us. You may terminate these T&C at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

11.1 These T&C and other policies and any other separate agreements whereby we provide you shall be governed by and construed in accordance with the laws of India with exclusive jurisdiction to the courts of Chennai.

11.2 Any dispute or difference either in interpretation or otherwise, of any terms of these Terms and Conditions between the parties hereto shall be referred to an independent arbitrator who will be appointed by EM Agri Goat Farm and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Chennai. The Madras High Court alone shall have the jurisdiction, and the Laws of India shall apply.

If any provision of these T&Cs or as a whole is held to be unlawful, void, invalid or otherwise unenforceable, then that provision will be limited or eliminated from the T&C to the minimum extent required, and the remaining provisions will remain valid and enforceable.
